Terms of Service

These Terms of Service ("Terms") govern your use of the Austen platform ("Service") operated by Austen ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms.

1. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must be at least 16 years old to use the Service.

2. Subscriptions and Billing

The Service is offered on a monthly subscription basis. Pricing is displayed on our website and may change with 30 days' notice. Payments are processed by Stripe. Subscriptions renew automatically unless cancelled before the next billing date. We do not offer refunds for partial billing periods.

3. Your Content

You retain ownership of all content you create using the Service, including articles, ideas, plans, and derivative content. You grant us a limited licence to store, process, and display your content solely to provide the Service to you. We do not claim any intellectual property rights over your content.

4. AI-Generated Content

Content generated by the Service uses third-party AI language models. You are responsible for reviewing, editing, and verifying all AI-generated content before publishing. We do not guarantee the accuracy, originality, or fitness for purpose of generated content. You should not rely on generated content for legal, medical, financial, or other professional advice.

5. Acceptable Use

You agree not to use the Service to:

  • Generate content that is unlawful, harmful, threatening, defamatory, or obscene
  • Impersonate any person or entity
  • Attempt to gain unauthorised access to the Service or its systems
  • Interfere with or disrupt the Service
  • Use automated means to access the Service beyond what is provided by our API
  • Resell or redistribute the Service without our written consent

We reserve the right to suspend or terminate accounts that violate these terms.

6. Usage Limits

Each subscription plan includes a monthly article generation limit. Usage resets at the start of each billing period. We may implement additional rate limits to ensure fair use and platform stability.

7. Third-Party Services

The Service integrates with third-party providers including OpenAI (content generation), Stripe (payments), Google (analytics), and Proofed (editing). Your use of these integrations is subject to their respective terms and privacy policies. We are not responsible for the availability or performance of third-party services.

8. Intellectual Property

The Service, including its design, code, and branding, is owned by us and protected by intellectual property laws. Your subscription grants you a non-exclusive, non-transferable licence to use the Service for its intended purpose.

9. Availability and Warranties

We strive to maintain high availability but do not guarantee uninterrupted service. The Service is provided "as is" without warranties of any kind, express or implied, including warranties of merchantability or fitness for a particular purpose.

10. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business opportunity arising from your use of the Service. Our total liability for any claim arising from these Terms is limited to the amount you paid us in the 12 months preceding the claim.

11. Termination

You may cancel your subscription and delete your account at any time from your profile settings. We may terminate or suspend your account for violation of these Terms. Upon termination, your content will be deleted in accordance with our Privacy Policy.

12. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes by email at least 14 days before they take effect. Continued use of the Service after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be resolved in the courts of England and Wales.
